General terms and conditions

Article 1 – Definitions

In these terms and conditions, the following terms shall have the following meanings:

  • Reflection period: the period within which the consumer can make use of their right of withdrawal.

  • Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

  • Day: calendar day.

  • Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

  • Durable medium: any instrument which enables the consumer or entrepreneur to store information personally addressed to them in a way accessible for future consultation and unaltered reproduction of the stored information.

  • Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period.

  • Entrepreneur: Acis Walking, the legal entity offering products and/or services remotely to consumers.

  • Distance contract: an agreement whereby exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.

  • Distance communication technology: means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time.

  • General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer from Acis Walking and to every distance contract and order concluded between Acis Walking and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, Acis Walking will indicate where the general terms and conditions can be accessed electronically before the contract is concluded.

Article 4 – The Offer

  • If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated.

  • The offer is without obligation. Acis Walking may change or adjust the offer.

  • All images, specifications, and data in the offer are indicative and do not give rise to claims for compensation or contract termination.

Article 5 – The Agreement

  • The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set forth.

  • If the agreement is concluded electronically, Acis Walking will implement appropriate technical and organizational measures to protect the electronic transfer of data and ensure a secure web environment.

  • Acis Walking reserves the right to refuse orders with valid justification.

Article 6 – Right of Withdrawal

  • The consumer has the right to withdraw from the agreement within 30 days after receiving the product, without giving any reason.

  • The product must be returned in its original condition and packaging, following the return instructions.

  • The consumer must notify Acis Walking via email at info@aciswalking.com within 30 days of receipt if they wish to exercise their right of withdrawal.

Article 7 – Costs in Case of Withdrawal

  • The consumer bears the cost of returning the product.

  • Acis Walking will refund the amount paid by the consumer as soon as possible, but no later than 14 days after receiving the returned product.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Products made to consumer specifications.

  • Sealed products that are not suitable for return due to health protection or hygiene reasons if the seal has been broken.

Article 9 – Pricing

  • All prices are stated in USD and include applicable taxes.

  • Additional customs or import duties (if applicable) are not included and are the responsibility of the customer.

  • Prices may be subject to change, but agreed prices remain valid for concluded agreements.

Article 10 – Warranty and Conformity

  • Acis Walking guarantees that the delivered products comply with the agreement, the stated specifications, and reasonable usability and durability.

  • Warranty does not apply in cases of misuse, improper handling, or unauthorized modifications.

  • Warranty claims must be made within 60 days after receipt of the product.

Article 11 – Delivery and Execution

  • Acis Walking will exercise the utmost care in receiving and executing product orders.

  • Orders are typically processed within 1–2 business days and shipped within the United States.

  • If delivery is delayed, the consumer will be notified within 30 days and may cancel the agreement.

  • Risk of product loss or damage is borne by Acis Walking until delivery to the consumer.

Article 12 – Payment

  • Payment must be completed before the order is processed unless otherwise agreed.

  • The consumer must promptly report any inaccuracies in payment details.

  • In case of non-payment, Acis Walking reserves the right to suspend or cancel the order.

Article 13 – Complaints Procedure

  • Complaints must be submitted in writing via email to info@aciswalking.com within 7 days of discovering a defect.

  • Acis Walking will respond within 14 days of receipt of the complaint.

  • If the complaint cannot be resolved mutually, it will be referred to dispute resolution.

Article 14 – Disputes

  • These terms and conditions are governed by U.S. law.

  • Any disputes shall be submitted to the competent court in the United States.
